- Chapter 7 Bankruptcy – This is the most commonly filed form of bankruptcy among individuals. It provides for liquidation, essentially allowing the debtor to make a fresh start. The debtor’s nonexempt assets are collected and reduced to cash, which is then distributed to the creditors.
- Chapter 11 Bankruptcy – This provides for reorganization, allowing the debtor to keep its business alive and pay back its creditors over time through a court-approved plan.
- Chapter 12 Bankruptcy – This chapter provides debt relief to family farmers, allowing them to restructure their finances and avoid foreclosure. The family farmer can continue to operate the farm while paying back his debt.
- Chapter 13 Bankruptcy – This chapter is for individuals who have a regular source of income, but currently are unable to pay his or her debts. Debtors propose a repayment plan to the court to repay creditors over three to five years.
