Local Lawyer, Chairman of Illinois Bar Section Council Advises Legislators on Effects of Proposed Bills and the Impact on Area Businesses

Belleville, IL, APRIL 19, 2012. Bradley W. Small, shareholder of Mathis, Marifian & Richter, Ltd. (MM&R), and chairman of the Illinois State Bar Section Council for Commercial Banking, Collections and Bankruptcy, recently met with state legislators to discuss numerous proposed bills that could affect the Illinois business community. The Section Council represents banks, creditors and businesses by providing practical information, monitoring fields of interest and anticipating problems for the profession through the practice and review of proposed new legislation and amendments to existing legislation.

Each year, the Section Council reviews hundreds of bills, many of them related to foreclosures and collections. For example, one such bill would require banks to fix up foreclosed properties despite not being the property owner. Another would limit what a consumer pays in small claims court, which would potentially impact an attorney's willingness to take the case.

Small commented, "It is the mission of the Section Council to review proposed bills and advise legislators of any possible negative consequences of those bills. While on the surface these bills appear to make sense and are consumer friendly, we often find in the review process that a bill in fact would cost consumers and businesses more in the end. We bring these issues to light when meeting with legislators so that an open and thought-provoking discussion of the bill can take place before it becomes law."
